Peachy Plans Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and BrandSpill Insights Inc., operating as Peachy Plans (“Peachy Plans,” “we,” “us,” or “our”).

These Terms govern your access to and use of the Peachy Plans website, mobile web application, and related services collectively referred to as the “Service.”

By creating an account, joining a trip, purchasing a Trip Pass, or otherwise using the Service, you agree to these Terms and acknowledge our Privacy Policy.

If you do not agree, do not access or use Peachy Plans.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use Peachy Plans.

You may not use the Service if:

  • You are under 18;
  • You are prohibited from using it under applicable law;
  • Your account was previously suspended for violating these Terms; or
  • You are accessing a trip without authorization.

If you use Peachy Plans on behalf of an organization, you represent that you have authority to bind that organization.

2. About Peachy Plans

Peachy Plans provides tools to help travelers:

  • Create and organize group trips;
  • Build daily itineraries;
  • Save destinations, addresses, reservations, and social links;
  • Add flights, transportation, stays, activities, food, tasks, and other plans;
  • Invite and collaborate with other travelers;
  • Assign editing permissions;
  • Add shared Day Notes;
  • Submit private mood check-ins;
  • Receive Peachy Insights;
  • Keep private Peachy Journal entries;
  • Create AI-assisted Group Notes; and
  • Receive selected email and in-app notifications.

Peachy Plans is a planning and communication platform. We are not a travel agency, tour operator, airline, hotel, transportation provider, booking agent, insurance provider, medical service, counselling service, crisis service, or emergency service.

3. Accounts

You agree to:

  • Provide accurate and current account information;
  • Use only your own account;
  • Protect your password and authentication credentials;
  • Notify us promptly of suspected unauthorized access;
  • Maintain accurate contact information; and
  • Accept responsibility for activity conducted through your account, except where prohibited by law.

You may not share passwords, sell accounts, or access another person's account without authorization.

We may require a password reset, revoke sessions, or take other protective measures if we reasonably suspect unauthorized access.

4. Authentication providers

Peachy Plans may allow sign-in through third-party providers such as Google or Apple.

Your relationship with the authentication provider is governed by that provider's terms and privacy policy. Using third-party authentication does not replace your obligation to accept these Terms and acknowledge the Peachy Plans Privacy Policy.

5. Trip roles and permissions

A trip may include the following roles:

Trip Lead

The Trip Lead is generally the creator or designated owner of the trip. The Trip Lead may manage trip settings, members, permissions, and content.

Editor

An Editor may create or modify trip information according to the permissions available in the Service.

Member

A Member may view shared trip information and use available participation features.

Members may also be able to create shared content, including tasks and Day Notes, where the product permits it.

Permissions are technical access levels. They do not create an employment, fiduciary, agency, partnership, or supervisory relationship between travelers.

The Trip Lead is responsible for selecting appropriate permissions. Peachy Plans is not responsible for authorized edits made by trip members.

6. Invitations and access codes

Trip invitations and access codes are intended only for authorized recipients.

You may not:

  • Sell or transfer an invitation;
  • Publicly distribute a private invitation;
  • Attempt to guess access codes;
  • Circumvent expiration, revocation, or single-use restrictions;
  • Use an invitation to join a trip without authorization; or
  • Share an invitation for fraudulent or unlawful purposes.

Peachy Plans may expire, revoke, or restrict suspicious invitations.

Joining a trip may make your name, profile image, role, shared notes, tasks, and completion activity visible to other authorized trip members.

7. Trip Passes and payments

Peachy Plans may offer a one-time Trip Pass that activates paid functionality for one eligible trip.

The current price, currency, taxes, and included functionality will be displayed at checkout.

Unless checkout clearly states otherwise:

  • A Trip Pass is a one-time purchase;
  • It is not an automatically renewing subscription;
  • It applies only to the identified trip; and
  • Invited travelers may join the activated trip without purchasing an additional pass.

Payments are processed by our third-party payment processor. You authorize the processor to charge the selected payment method for the amount displayed at checkout.

Peachy Plans does not directly store complete payment-card numbers or card security codes.

8. Refunds

Refund eligibility is subject to applicable consumer-protection law.

You may request a refund within 14 days after purchase if the Trip Pass has not been materially used.

A Trip Pass may be considered materially used when, for example:

  • Multiple travelers have joined;
  • Substantial trip content has been created;
  • Paid notifications have been sent; or
  • Paid functionality has otherwise been actively used.

Duplicate or unauthorized charges should be reported promptly to team@peachyplans.co.

If you purchased through a third-party marketplace, that marketplace's refund rules may apply.

Nothing in this section limits mandatory refund or cancellation rights.

9. User Content

“User Content” includes information users submit to Peachy Plans, such as:

  • Trip details;
  • Itinerary items;
  • Addresses;
  • Reservation information;
  • Tasks;
  • Day Notes;
  • Group Notes;
  • Journal entries;
  • Links;
  • Images;
  • Comments; and
  • Other submitted material.

You retain ownership of your User Content.

You grant Peachy Plans a limited, non-exclusive, worldwide licence to host, store, reproduce, process, transmit, and display User Content only as reasonably necessary to:

  • Operate the Service;
  • Share content with authorized trip members;
  • Provide requested AI features;
  • Process notifications;
  • Maintain security;
  • Comply with law; and
  • Enforce these Terms.

This licence ends when the content is deleted, subject to reasonable backup periods, legal retention, security records, and copies of shared content retained as part of another user's trip experience.

You represent that you have the right to submit User Content and that doing so does not violate another person's privacy, intellectual property, or other rights.

10. Information about other people

You may add information concerning other travelers, such as names, assignments, flight details, dietary notes, or reservation information.

You must have an appropriate reason and any required permission before submitting another person's information.

Do not add sensitive information that is unnecessary for trip coordination.

11. Tasks

Tasks are shared itinerary items. Depending on product functionality, joined members may create, assign, complete, reopen, edit, or delete tasks.

Task information may show:

  • The task;
  • The assignee;
  • The creator;
  • The due date and time;
  • Completion status; and
  • Who marked it complete.

Tasks should be used collaboratively. You may not use tasks to harass, shame, control, or humiliate another traveler.

12. Day Notes

Day Notes are shared comments associated with a particular trip date.

Day Notes are visible to authorized trip members and may display the author's name and timestamp. They are not private Journal entries and are not anonymous Group Notes.

Users may edit or delete their own Day Notes. Trip Leads or Editors may remove notes where necessary to address misuse or protect the trip experience.

13. Mood check-ins and Peachy Insights

Pulse allows travelers to submit private mood check-ins.

Individual mood selections and private reasons are not intended to be displayed to other travelers or the Trip Lead.

Peachy Plans may use privacy-protected patterns to provide general Peachy Insights intended to support group dynamics. Peachy Insights:

  • Are general suggestions;
  • May be generated or assisted by AI;
  • Do not guarantee improved group dynamics;
  • Must not be treated as medical or psychological advice; and
  • Should not identify the traveler whose check-in influenced an insight.

14. Peachy Journal

Peachy Journal is a private reflection feature.

Journal entries are not automatically shared with the trip group. A Journal entry will not automatically become a Group Note.

Peachy Plans may privately suggest that you transform part of a Journal entry into a Group Note. Before anything is shared, you must:

  • Review the proposed Group Note;
  • Approve its exact wording;
  • Choose when it will be published; and
  • Confirm publication.

The private Journal is not therapy, counselling, medical advice, crisis support, or emergency assistance.

If you or someone else may be in immediate danger, contact local emergency services or an appropriate qualified professional.

15. Group Notes

Group Notes are short messages shared with authorized trip members.

When a Group Note is created from private content:

  • The original private content remains private;
  • Only the approved Group Note is shared;
  • The author's name does not appear on the recipient-facing note; and
  • Peachy Plans may retain restricted ownership metadata for security, abuse prevention, and author-controlled editing.

Users may not use Group Notes to:

  • Threaten or harass another person;
  • Target or humiliate a traveler;
  • Publish private or identifying information;
  • Impersonate another person;
  • Make knowingly false or unlawful allegations; or
  • Circumvent moderation.

Peachy Plans may block, remove, or preserve content where reasonably necessary for safety, security, legal compliance, or enforcement.

16. AI-assisted features

Peachy Plans may use artificial intelligence to:

  • Rewrite text;
  • Suggest kinder or clearer wording;
  • Generate general Peachy Insights;
  • Categorize submitted content;
  • Moderate unsafe content; and
  • Assist with trip planning.

AI output may be inaccurate, incomplete, repetitive, or inappropriate.

You are responsible for reviewing AI output before approving, sharing, or relying on it.

Do not rely on Peachy Plans AI for:

  • Medical advice;
  • Legal advice;
  • Emergency decisions;
  • Personal safety decisions;
  • Visa or immigration requirements;
  • Flight status;
  • Financial advice; or
  • Other professional or safety-critical decisions.

Peachy Plans does not guarantee that AI will correctly understand the context, tone, or seriousness of an entry.

17. Email communications

Essential emails

Peachy Plans may send emails necessary to operate or secure your account, including:

  • Email verification;
  • Password resets;
  • Security alerts;
  • Purchase receipts;
  • Refund confirmations;
  • Support responses;
  • Account deletion notices; and
  • Material legal notices.

You may not be able to disable essential communications while maintaining the relevant account or transaction.

Optional trip emails

You may choose to receive:

  • Trip invitations;
  • Planning reminders;
  • Daily itinerary summaries;
  • Schedule changes;
  • Task reminders;
  • Group Note notifications; and
  • Other trip activity.

You can manage optional trip emails globally or by trip.

Marketing emails

If you separately opt in, Peachy Plans may send product updates, newsletters, travel inspiration, promotions, or offers.

Marketing consent is optional and is not required to create an account, join a trip, or purchase a Trip Pass.

You may unsubscribe using the link in a marketing email or through Notification Settings.

Unsubscribing from marketing does not stop essential account, security, purchase, or legal communications.

19. Travel and third-party information

Peachy Plans does not independently verify or guarantee:

  • Flight details;
  • Reservation information;
  • Addresses;
  • Opening hours;
  • Travel duration;
  • Weather;
  • Prices;
  • Availability;
  • Entry requirements;
  • Safety information; or
  • Third-party links.

You are responsible for confirming critical information directly with the appropriate airline, accommodation, transportation provider, government, venue, or other source.

Peachy Plans is not responsible for:

  • Delayed or cancelled travel;
  • Lost reservations;
  • Conduct of trip members;
  • Injury or property loss;
  • Third-party service outages; or
  • Acts or omissions of travel providers.

20. Acceptable use

You may not:

  • Use the Service unlawfully;
  • Harass, threaten, or exploit another person;
  • Access another trip without authorization;
  • Upload malicious code;
  • Attempt to compromise the Service;
  • Circumvent roles, permissions, or security controls;
  • Scrape or harvest user data;
  • Abuse invitations or notifications;
  • Send spam;
  • Infringe intellectual-property rights;
  • Submit deceptive, defamatory, or unlawful content;
  • Use AI to create abusive or unlawful material;
  • Misrepresent your identity; or
  • Interfere with another user's access.

21. Intellectual property

Except for User Content, Peachy Plans and its software, interface, designs, text, graphics, branding, and other materials are owned by or licensed to BrandSpill Insights Inc.

We grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended personal purposes.

You may not copy, sell, license, reverse engineer, or commercially exploit the Service except where applicable law expressly permits it.

22. Feedback

If you voluntarily provide feedback, you grant Peachy Plans permission to use it to improve and market the Service without compensation.

We will not publicly attribute feedback to you without permission.

23. Service availability and changes

We may update, modify, suspend, or discontinue features.

We do not guarantee uninterrupted or error-free availability.

Where reasonably practical, we will notify users of changes that materially reduce paid functionality.

24. Suspension and termination

You may stop using the Service and request account deletion.

We may suspend or terminate access for:

  • Material violations of these Terms;
  • Fraud or payment abuse;
  • Harassment;
  • Security threats;
  • Unauthorized access;
  • Unlawful conduct;
  • Risk of harm; or
  • Legal requirements.

Where appropriate, we may provide notice and an opportunity to appeal.

25. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.”

Peachy Plans does not warrant that:

  • The Service will always be available;
  • All errors will be corrected;
  • Trip information is accurate;
  • AI output is correct;
  • Notifications will always be delivered;
  • Group Notes will prevent conflict; or
  • Peachy Insights will improve group dynamics.

These disclaimers do not limit mandatory warranties or consumer rights that cannot be waived.

26. Limitation of liability

To the maximum extent permitted by law, Peachy Plans and BrandSpill Insights Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, profits, goodwill, travel opportunities, or enjoyment.

To the maximum extent permitted by law, our total liability arising from the Service will not exceed the greater of:

  • The amount you paid Peachy Plans during the 12 months preceding the event giving rise to the claim; or
  • USD $100.

These limitations do not apply where prohibited by law, including liability that cannot legally be excluded or limited.

27. Indemnification

To the extent permitted by law, you agree to indemnify BrandSpill Insights Inc. against third-party claims arising from:

  • Your unlawful use of the Service;
  • Your User Content;
  • Your violation of another person's rights; or
  • Your material breach of these Terms.

This does not apply to the extent a claim was caused by our own conduct or where indemnification is prohibited by law.

28. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario, Canada, and applicable federal laws, without overriding mandatory consumer protections in the jurisdiction where you reside.

Before filing a claim, you agree to contact team@peachyplans.co and attempt to resolve the issue informally.

Nothing in these Terms eliminates rights or legal forums that cannot lawfully be waived.

29. Changes to these Terms

We may update these Terms to reflect changes to the Service, law, or business practices.

For material changes, we will provide appropriate notice and request renewed acceptance where required.

The effective date at the top identifies the current version.
